High court dismiss Chizuzu’s case against ZIFA elections

Journalist Hope Chizuzu’s bid to stop ZIFA’s elections has hit a brick wall.

Last week Chizuzu had filed an urgent application against ZIFA in order to stop the upcoming Zifa elections.

Chizuzu was challenging the legality of the Zifa electoral committee.

The case was placed before Honourable Mr Justice Musakwa who ruled that the matter did not qualify to be heard on an urgent basis.

The matter has since been removed from the roll of urgent matters.

In his ruling Justice Musakwa commented as follows:-

“1. This matter does not qualify to be heard on urgent basis

2. The application appears to have been prepared in a hurry such that there is discordance between the averments made in the certificate of urgency and the founding affidavit regarding whether the application filed nomination papers.

3. If the applicant has not seen the minutes on the appointment of electoral committee it is not clear why the alleges it was not appointed by the respondent

4. Irreparable harm founding urgency is not well articulated. The contention that the pending elections might be nullified in future cannot amount to irreparable harm.

5. There are other satisfactory remedies available to the applicant. Therefore the matter is removed from the roll of urgent matters”.
